A man who was caught over the limit in Fishguard behind the wheel of his uncle’s car has been banned from driving for 20 months.
Thirty-six-year-old Ricky Kinsella, of St. Dogmaels, appeared at Haverfordwest Magistrates Court on Tuesday (May 1) to face driving offence charges.
He pleaded guilty to driving a Ford Focus on a road in Gwelfor, Fishguard, after exceeding the prescribed limit of alcohol; driving a motor vehicle otherwise in accordance wit a licence; and using a motor vehicle in a public place without third parry insurance.
Prosecutor Abul Hussain told the court that Mr. Kinsella was stopped by police on March 31, after his uncle had reported his vehicle as stolen.
“Officers approached Mr. Kinsella in the vehicle and thought he might be under the influence of drink or drugs. A roadside breath test proved positive, and at the police station Mr. Kinsella gave a reading of 83 microgrammes of alcohol in 100 millitres of breath.
“The defendant has a number of previous convictions, but all of a dissimilar nature,” added Mr. Hussain.
Defence solicitor Jonathan Webb told the court that Mr. Kinsella had asked his uncle if he could borrow the car to run some errands.
“The night before he’d had a shed-full to drink, and thought he would be ok to drive, but clearly wasn’t,” he said.
Magistrates disqualified Mr. Kinsella from driving for 20 months and fined him £120 for the offence. He was also ordered to pay prosecution costs of £85 and a £30 victim surcharge.
“Your solicitor summed it up, you had a shed-full the night before and very foolishly went driving the morning after. You’re going to be a doing a lot of walking in the next 20 months, and using lots of buses and taxis, but what you won’t be doing is driving!” chief magistrate David Simpson told the defendant.
