A St Florence man has appeared in court on drugs possession charges after packets containing cannabis fell out of his pocket at a Tenby nightclub on New Year’s Eve.
Twenty-year-old Kyle Birch admitted a charge of possessing 6.1 grams of cannabis, when he appeared at Haverfordwest Magistrates Court on Tuesday.
Prosecutor Sophie Hill told the court that the incident occurred at the Prince of Wales premises when the defendant was spotted by a member of staff recovering the packets which had fallen out of his back pocket,
“He dropped a bag on the floor when he was searching his back pocket, and four small packets, each containing around 1.5 grams of cannabis, wrapped in plastic fell out,” she explained.
Police attended the premises and Mr. Birch was arrested. The court heard how he had a limited antecedent history, but was still serving a community order for an offence committed last March, of possessing cannabis with intent to supply.
Defence solicitor Mike Kelleher told the court that the incident occurred on New Year’s Eve in the resort, and that Mr. Birch explained to police that the drugs were for his own personal use.
Magistrates told the defendant that they were concerned that he was back in court for drug offences whilst he was still on a community order, before fining him £80 for the charge, and ordering him to pay prosecution costs of £85 and a £30 victim surcharge.
A forfeiture and destruction order was also passed for the drugs.
